    Is #2 correct? If so, which one is better?

Only the first is correct.

Here is the definition of the phrase “in the right” in a dictionary:
in the right
If you are in the right, what you are doing is morally or legally correct.
I know I’m in the right. You are not in the right on this point.
It has a different meaning!

That’s because it is a different usage.
